MEMPHIS, TN — A JustMyMemphis investigation has uncovered evidence that the Shelby County Clerk’s Office is systematically violating Tennessee State Law by holding millions of dollars in public funds in "sealed packets" for up to 90 days before depositing them.

While Shelby County Trustee Regina Morrison Newman’s office manages a "daily sweep" of all county accounts to maximize investment interest for taxpayers, the Clerk’s Office—under the leadership of Wanda Halbert—is reportedly leaving those funds on the floor, un-opened and un-earned.

The 72-Hour Mandate

According to Tennessee Code § 5-8-207, every county official handling public funds is legally required to deposit those funds into an official bank account within three (3) days of receipt. Failure to do so is a Class C Misdemeanor.

In an exclusive interview with Clerk’s Office leadership, JustMyMemphis confirmed that the office has adopted a policy of "First In, First Out" (FIFO) that ignores the 72-hour legal mandate. Instead, the office manages its backlog based on when checks expire—often 60 to 90 days after they were written.

The "Sealed Packet" Loophole

Sources within the Clerk’s Office admit that dealer registration packets—which often contain checks for thousands of dollars in taxes and fees—are kept sealed until the office has the staff or "overtime budget" to process them.

"The packages are sealed and are not valid until we open the pack," one official claimed.

However, the law does not recognize a "sealed envelope" as a legal shield. The moment a payment enters a government building, the 72-hour clock begins. By holding these checks, the Clerk’s Office is not just delaying license plates; they are intentionally stalling the flow of revenue into the County’s investment pool.

The Cost of Inaction

Because the Shelby County Trustee’s office sweeps all official accounts daily to invest funds into interest-bearing opportunities, every day a check sits in an envelope is a day that money isn't working for the citizens of Memphis.
